OVERVIEW

All visual, photographic, video, audio, and written content appearing on the Army Navy Outdoors website, social media channels, marketing materials, and advertising is the exclusive intellectual property of Army Navy Outdoors unless otherwise expressly noted. This policy governs the ownership, use, and protection of that content — including content created with the assistance of artificial intelligence tools — and describes our practices regarding the use of our own models and personnel in brand imagery.


This policy is incorporated by reference into the Army Navy Outdoors Terms and Conditions and should be read together with those Terms.


SECTION 1 — COPYRIGHT & OWNERSHIP OF ALL SITE CONTENT

All content on this website and across Army Navy Outdoors marketing platforms — including but not limited to product photography, lifestyle imagery, campaign visuals, graphic design, written copy, video content, and audio — is protected by United States copyright law and applicable international copyright treaties.

No content appearing on this website or any Army Navy Outdoors platform may be reproduced, downloaded, distributed, transmitted, displayed, published, modified, or used in any form — in whole or in part — without the express prior written consent of Army Navy Outdoors. Unauthorized use of our content constitutes copyright infringement and may result in civil and/or criminal liability.


SECTION 2 — USE OF MODELS & PERSONNEL IN BRAND IMAGERY

Army Navy Outdoors frequently features real individuals — including professional models, brand ambassadors, employees, and contracted personnel — in our photography, video, and marketing content. All individuals appearing in our branded content have provided express written consent for their participation and for the use of their likeness, image, and voice in Army Navy Outdoors marketing materials. Where Army Navy Outdoors may also use its own authorized models as a basis for AI-assisted editing, enhancement, or digital modification, such use is conducted with the prior written knowledge and consent of those individuals, specifying the scope, purpose, and nature of any AI-assisted processes applied to their likeness.


Army Navy Outdoors does not currently, and does not intend to, create, distribute, or commercially use AI-generated digital replicas of any individual — living or deceased — without appropriate authorization. In compliance with New York law and applicable right-of-publicity statutes in other jurisdictions, we do not use the digital likeness, voice, or image of deceased individuals for commercial purposes without obtaining consent from the appropriate rights holders or estates.


SECTION 3 — USE OF ARTIFICIAL INTELLIGENCE IN CONTENT CREATION

Army Navy Outdoors may utilize artificial intelligence in two distinct ways as part of its content creation and marketing practices:


3A. AI-Assisted Editing and Enhancement


Army Navy Outdoors may use AI-powered tools as part of its standard graphic design, copy text, photo editing, video production, and marketing workflows. These tools may be used to enhance, modify, retouch, or adjust existing content — including imagery of our own models, product photography, and promotional materials — consistent with standard industry editing practices. While this content originates from real photography and video recordings of authorized models and personnel, AI-assisted editing processes may occasionally produce outputs that unintentionally resemble the likeness, voice, or appearance of an unaffiliated individual. Any such resemblance is purely coincidental and is an inherent characteristic of AI-assisted editing technologies, not the result of intentional creative direction by Army Navy Outdoors.


3B. AI-GENERATED SYNTHETIC CONTENT


From time to time, Army Navy Outdoors may also create visual content — including human figures, models, and environments — entirely through the use of artificial intelligence via text-based prompts or other generative AI tools. Such content may constitute a “synthetic performer”. Any AI-generated figures produced in this manner do not represent any specific real individual, and any resemblance to any actual person, living or deceased, is entirely coincidental and unintended.


Where Army Navy Outdoors uses synthetic performers in advertising content, conspicuous disclosure will be provided at the point of publication in compliance with applicable federal and state law. Such disclosures will appear directly within or adjacent to the advertisement or content in which synthetic content appears.


SECTION 4 — HUMAN OVERSIGHT & CONTENT REVIEW

Army Navy Outdoors maintains human creative direction and oversight over all AI-assisted and AI-generated content prior to publication. This human involvement is integral both to our brand standards and to ensuring that AI remains a tool in service of our creative process rather than a replacement for it. This human oversight also supports our ability to assert copyright protection over content in which our team has provided substantial creative direction, consistent with current U.S. Copyright Office guidance on human authorship in AI-assisted works.


Army Navy Outdoors reviews all AI-generated and AI-modified content prior to publication in a good-faith effort to identify and avoid unintended recognizable likenesses of unaffiliated individuals. However, we acknowledge that AI tools may produce unforeseeable outputs despite reasonable review efforts.


SECTION 5 — THIRD-PARTY AI TOOLS

AI-assisted editing and generative tools that may be used by Army Navy Outdoors may be provided by third-party platforms, each subject to their own terms of use, content policies, and licensing frameworks. Army Navy Outdoors operates in compliance with the terms of all third-party tools utilized in its content creation process.


SECTION 6 — REMOVAL REQUESTS

If you believe that any content published by Army Navy Outdoors depicts your likeness, image, or voice without authorization, please contact us promptly at [contact email/address]. We will review all requests in good faith and, where appropriate, will remove or modify the content in question within a reasonable timeframe.


SECTION 7 — GOVERNING LAW & POLICY UPDATES

This policy is governed by the laws of the State of Texas. Army Navy Outdoors monitors developments in federal and state AI regulation on an ongoing basis and will update this policy as laws and best practices evolve.
